GEMA obtains court order against RapidShare غيما يحصل على امر من المحكمه ضد rapidshare
GEMA , Germany’s society for musical performing and mechanical reproduction rights, has obtained temporary injunctions against the operator of popular data exchange services RapidShare.de and RapidShare.com . غيما ، والمجتمع في المانيا لاداء الموسيقيه والميكانيكيه استنساخ الانسان ، قد حصل على اوامر مؤقتة ضد المشغل الشعبية خدمات تبادل البيانات rapidshare.de وrapidshare.com.
RapidShare.com is said to have used copyrighted works of GEMA members “in an unlawful fashion”. Rapidshare.com يقال انها تستخدم حقوق الطبع والنشر ويعمل غيما من اعضاء "بطريقة غير مشروعة".
The RapidShare.com & .de services operate in a near identical fashion. وقد rapidshare.com &. دي الخدمات تعمل في القريب بطريقة مماثلة. They both allow users to upload content on virtual storage space, which therefore makes it publicly available. انها على حد سواء للسماح للمستخدمين تحميل المحتوي على الفضاء الافتراضي والتخزين ، ومن ثم يجعل في متناول الجمهور.

The collecting society is demanding details be revealed by RapidShare’s operator of exactly how many copyrighted files of GEMA artists it currently stores without permission. جمعية التحصيل تطالب التفاصيل التي كشفت عنها rapidshare مشغل بالضبط عدد من ملفات حقوق الطبع والنشر للفنانين غيما المخازن حاليا من دون الحصول على اذن. However, according to Geyer, RapidShare has to date claimed it has no knowledge or control of the content uploaded by its users. بيد انه وفقا لغيير ، وقد rapidshare المطالب حتى الان ليس لديها اى علم او السيطرة على مضمون التي تم تحميلها من قبل المستخدمين.
The District Court in Cologne, from whom the injunctions were obtained, has made it clear that although it was the users and not the operators that uploaded the content in question to the RapidShare servers, this did not, (at least from a legal point of view), make the operator of RapidShare any less liable for copyright infringements occurred within the context of the services. محكمة المقاطعه في كولونيا ، من الذين تم الحصول على الاوامر ، ولقد اوضحت انه على الرغم من ان مستخدمي ومشغلي لا ان تم تحميلها في مضمون المساله الى rapidshare الخدمة ، إلا أن ذلك لم يوفر ، (على الأقل من الناحية القانونية راي) ، وجعل مشغل rapidshare اي اقل عرضة لانتهاكات حقوق الطبع والنشر وقعت ضمن سياق الخدمات.
Harald Heker , the chairman of the executive board of GEMA, believes the outcome of the court’s decisions will have a knock on effect with the way “Web 2.0 services” such as YouTube and MySpace will be dealt with in the future. هارالد heker ، رئيس المجلس التنفيذي للغيما ، وترى نتائج قرارات المحكمه سيكون لها اثر طرق مع الطريق "ويب 2،0 الخدمات" مثل YouTube ميسباكي وسيتم التعامل مع هذا في المستقبل.
Heker believes that such decisions show is that “the mere circumstance of shifting acts of use to users and the purported inability of the operator to control content do not relieve the operator of a service from the copyright liability he/she/it possesses for the content made available for download from the operator’s website” . Heker تعتقد ان مثل هذه القرارات هو اظهار ان "مجرد ظرف من الظروف للانتقال الى استخدام أعمال المستخدمين والمفترض عدم قدرة المشغل للسيطره على محتوى لا تعفي المشغل للخدمة حقوق الطبع والنشر من المسؤولية ويقوم / / لأنه يملك محتوى متاحة للتحميل من موقع المشغل ".
